No one wants to submit an appeal, as it usually means that the Local Planning Authority refused your application, failed to determine it within a reasonable time period, or has taken enforcement action.  But it can be part of the planning journey and in some instances part of an overall planning strategy.

An appeal is made to the Planning Inspectorate, which acts on behalf of the Secretary of State.  It is an independent body that will consider both sides of the argument and reach a balanced decision.

We prepare all planning evidence relevant to the appeal and support the whole appeal process.  We advise on any additional support needed from technical consultants, and work with a team to maximise the chances of a successful outcome.

There are three types of planning appeal – written, hearing and public inquiry. We will advise on the best approach for your proposal, having regard to the appropriate guidance.

For Public Inquiries, you will need a Barrister to be instructed – which we are able to  do on your behalf as part of the licensed access scheme. 

At times the decision of a Local Planning Authority or Inspector can be questionable.  Our consultants will advise on whether there is any scope to challenge a decision, which can only be challenged via a Judicial Review submitted to the High Court.
